Terms and conditions


BROTHER A3 CASH BACK PROMOTION (Please read carefully)

1. Information on how to enter and claim cashback form part of these Terms and Conditions of offer. Participation in this promotion is deemed acceptance of these Terms and Conditions.

2. Offer is only open to residents of Australia. Employees and the immediate families of the Promoter and its agencies (including but not limited to Brother’s resellers) associated with this promotion are ineligible.

3. To be eligible, consumers must purchase one of the following Brother products from an authorised and participating Brother reseller within Australia: MFC-5890CN, MFC-6490CW, MFC-6890CDW between 1st September 2010 and 31st October 2010 (inclusive). Officeworks, Dick Smith, Big W and Tandy are non-participating resellers.

4. In order to make a valid claim, consumers must complete and submit an online claim at www.brother-cash.com.au, make a photocopy of their tax invoice as proof of purchase (delivery dockets are not acceptable as proof of purchase), write their name and auto generated tracking claim code on the back of the tax invoice, and send via mail to “Brother Cash back Promotion” PO Box 1632 North Sydney NSW 2060 within 30 days of purchase date.

5. Subject to eligibility of claim, claimants who purchase a new Brother MFC-5890CN or MFC-6490CW will receive $50 cash back or MFC-6890CDW $100 cash back.

6. The cash back amount issued is inclusive of GST and will be issued by either PayPal payment into a PayPal account specified by the email address of the claimant, or Electronic Funds Transfer (EFT).

7. If PayPal is the chosen payment method, payment will be made via PayPal within 5 working days of the date of receipt of a valid proof of purchase. If payment does not occur, call the customer service team on 1300 974 655.

8. Multiple purchases permitted, subject to the following:

  (a) only one claim permitted per specified purchase requirement; and
  (b) each claim must be submitted in accordance with claim requirements.

9. Valid for eligible purchases made between cash back between 1st September 2010 and 31st October 2010 (inclusive).

10. Proof of purchase (Tax Invoice) to be sent to “Brother Cash back Promotion” PO BOX 1632 North Sydney NSW 2060 within 30 days of purchase date. The purchase date is determined by the date printed on the Brother authorised reseller’s tax invoice submitted as proof of purchase. Any claims or proof or purchase received after the aforementioned 30 days will be deemed invalid.

11. The Promoter reserves the right, at any time, to verify the validity of claims (including contacting the place of purchase) and claimants (including a claimant’s identity, age and place of residence) and to disqualify any claimant who submits a claim that is not in accordance with these Terms and Conditions or who tampers with the claim process. Failure by the Promoter to enforce any of its rights at any stage does not constitute a waiver of those rights. The claimant agrees that if they have obtained the cash back, they will pay back the Promoter the value of the cash back, if they subsequently return the product to the place of purchase and seek a refund under any returns policy that the relevant reseller may have.

12. The Promoter accepts no responsibility for late, lost, damaged, stolen or misdirected mail. Incomplete, indecipherable, or illegible claims will be deemed invalid.

13. Claimants must retain a copy of their tax invoice for all claims as proof of purchase. Failure to produce the proof of purchase for all claims when requested may, in the absolute discretion of the Promoter, result in invalidation of ALL of a claimant’s claims and forfeiture of any right to cash back. The tax invoice must clearly specify the store of purchase, tax invoice number and purchase date.

14. If there is a dispute as to the identity of a claimant, the Promoter reserves the right, in its sole discretion, to determine the identity of the claimant.

15. The Promoter’s decision is final and no correspondence will be entered into.

16. The Promoter collects personal information in order to conduct the Promotion. If the claimant un-checks the appropriate box on the online claim form, the Promoter may, for an indefinite period unless otherwise advised, use the information for promotional, marketing and publicity purposes including sending electronic messages or telephoning the entrant. Claimants should direct any requests to access, update or correct information to the Promoter. All claims become the property of the Promoter. 17. It is the responsibility of the claimant to provide the correct details for the PayPal account for the cash back payment to be made into. Where a claimant does not have a PayPal account he or she can create one and should go to http://www.paypal.com.au for more information and to read the Product Disclosure Statement issued by PayPal. Payments into a PayPal account will be made within 5 working days of the receipt being received and validated.

18. It is the responsibility of the claimant to provide the correct details for the bank account for the cash back payment to be made into if choosing payment by EFT. Payments via EFT will be made within 5 working days of the proof of purchase being received and validated. Returned funds will be subject to a fee from the bank. This fee will be passed onto the claimant and will be deducted from any cash back payment thereafter.

19. If the claimant of offer is under the age of 18 years, the cash back will be awarded to the claimant’s nominated parent or guardian.

20. The Promoter accepts no responsibility for any tax implications that may arise from this promotion. Independent financial advice should be sought by the claimant.

21. Except for any liability that cannot be excluded by law, the Promoter (including its officers, employees and agents) excludes all liability (including negligence), for any personal injury; or any loss or damage (including loss of property); whether direct, indirect, special or consequential, arising in any way out of the Promotion, including, but not limited to, where arising out of the following:

  (a) any technical difficulties or equipment malfunction (whether or not under the Promoter’s control);
  (b) any theft, unauthorised access or third party interference;
  (c) any claim or offer that is late, lost, altered, damaged or misdirected (whether or not after their receipt by the Promoter) due to any reason beyond the reasonable control of the Promoter;
  (d) any variation in the offer value to that stated in these Terms and Conditions; or
  (e) participation in the offer.

22. Claims are not transferable, assignable or exchangeable for other goods or services.

23. Claims cannot be made on back orders.

24. This offer cannot be combined with any other promotional offer. This includes special deal pricing or government pricing.

25. This offer is not valid for rental or leasing agreements.
