BROTHER CASHBACK PROMOTION TERMS AND CONDITIONS

  1. Information on how to enter and claim cashback form part of these Terms and Conditions of offer. Participation in this promotion is deemed acceptance of these Terms and Conditions.

  2. Offer is only open to residents of Australia. Employees and the immediate families of the Promoter and its agencies (including but not limited to Brother’s resellers) associated with this promotion are ineligible.

  3. To be eligible, consumers must purchase one of the following Brother Inkjet products or Brother product combinations from an authorised and participating Brother reseller within Australia: MFC-J5910DW; MFC-J6710DW for $50 Cashback or MFC-J6910DW for $100 Cashback between 1st October 2011 and 29th February 2012 (inclusive); or purchase DCP-J125 with LC-39CL 3PK; DCP-J315W with LC-39CL 3PK; DCP-J515W with LC-39CL 3PK (Exclusive to The Good Guys); MFC-J220 with LC-39CL 3PK; MFC-J415W with LC-39CL 3PK for $30 Cashback or DCP-J525W with LC-73CL 3PK; DCP-J715W with LC-67CL 3PK (Exclusive to Harvey Norman); DCP-J725DW with LC-73CL 3PK; DCP-925DW with LC-73CL 3PK; MFC-J430W with LC-73CL 3PK; MFC-J625DW with LC-73CL 3PK; MFC-J825DW with LC-73CL 3PK for $50 Cashback between 1st November 2011 and 29th February 2012 (inclusive). Officeworks and Big W are non-participating resellers. An LC67CL3PK, LC73CL3PK or LC39CL3PK is 3 Colour Value Pack (Cyan, Magenta and Yellow). 3 Colour Value Packs must be purchased in the same transaction and invoice as the inkjet printer/MFC.

    To be eligible, consumers must purchase one of the following Brother Laser products or Brother product combinations from an authorised and participating Brother reseller within Australia: HL-5370DW; HL-5380DN; HL-4150CDN for $50 Cashback or MFC-8880DN; MFC-8890DW; HL-4570CDW; DCP-9055CDN; MFC-9460CDN; MFC-9970CDW for $100 Cashback or HL-2250DN with TN-2250; MFC-7460DN with TN-2250 (Exclusive to Harvey Norman) for $50 Cashback between 1st November 2011 and 29th February 2012 (inclusive). Officeworks and Big W are non-participating resellers. A TN-2250DN is a genuine Brother toner. Toner must be purchased in the same transaction and invoice as the Laser printer/MFC.

  4. In order to make a valid claim, consumers must complete and submit an online claim at www.brother-cash.com.au, make a photocopy of their tax invoice as proof of purchase (delivery dockets are not acceptable as proof of purchase), write their name and auto generated tracking claim code on the back of the tax invoice, and send via mail to “Brother Cashback Promotion” PO Box 1632 North Sydney NSW 2060 within 30 days of purchase date.

    If the product has been purchased through Qantas, Flybuys or Commonwealth Bank rewards points, customers are still eligible to claim the cashback amount provided the customer submits an online claim form at www.brother-cash.com.au, make a photocopy of their confirmation page from the Rewards company showing the date, product and unique redemption/order number. Customers are required to mail the print out to “Brother Cashback Promotion” PO Box 1632 North Sydney NSW 2060 within 30 days of redemption date.

  5. The cashback amount issued is inclusive of GST and will be issued as a Citi® Prepaid Card or Electronic Funds Transfer (EFT).

  6. Payments will be issued within 5 working days of the proof of purchase being received and validated. Cards are issued by Citigroup Pty Ltd pursuant to a license from MasterCard® International Incorporated and managed by Citi Prepaid Services. MasterCard is a registered trademark of MasterCard International Incorporated. Cards will not have cash access and can be used everywhere MasterCard Prepaid Cards are accepted.

  7. Multiple purchases permitted, subject to the following: (a) only one claim permitted per specified purchase requirement; and (b) each claim must be submitted in accordance with claim requirements.

  8. Valid for eligible purchases made between 1st October 2011 and 29th February 2012 (inclusive) for the listed A3 Inkjet Multi-Function Centres.

  9. Proof of purchase (Tax Invoice) to be sent to “Brother Cashback Promotion” PO Box 1632 North Sydney NSW 2060 within 30 days of purchase date. The purchase date is determined by the date printed on the Brother authorised reseller’s tax invoice submitted as proof of purchase. Any claims or proof of purchase received after the aforementioned 30 days will be deemed invalid.

  10. The Promoter reserves the right, at any time, to verify the validity of claims (including contacting the place of purchase) and claimants (including a claimant’s identity, age and place of residence) and to disqualify any claimant who submits a claim that is not in accordance with these Terms and Conditions or who tampers with the claim process. Failure by the Promoter to enforce any of its rights at any stage does not constitute a waiver of those rights. The claimant agrees that if they have obtained the cashback, they will pay back the Promoter the value of the cashback, if they subsequently return the product to the place of purchase and seek a refund under any returns policy that the relevant reseller may have.

  11. The Promoter accepts no responsibility for late, lost, damaged, stolen or misdirected mail. Incomplete, indecipherable, or illegible claims will be deemed invalid.

  12. Claimants must retain a copy of their tax invoice for all claims as proof of purchase. Failure to produce the proof of purchase for all claims when requested may, in the absolute discretion of the Promoter, result in invalidation of ALL of a claimant’s claims and forfeiture of any right to cashback. The tax invoice must clearly specify the store of purchase, tax invoice number and purchase date.

  13. If there is a dispute as to the identity of a claimant, the Promoter reserves the right, in its sole discretion, to determine the identity of the claimant.

  14. The Promoter’s decision is final and no correspondence will be entered into.

  15. The Promoter collects personal information in order to conduct the Promotion. If the claimant un-checks the appropriate box on the online claim form, the Promoter may, for an indefinite period unless otherwise advised, use the information for promotional, marketing and publicity purposes including sending electronic messages or telephoning the entrant. Claimants should direct any requests to access, update or correct information to the Promoter. All claims become the property of the Promoter.   16. It is the responsibility of the claimant to provide the correct mailing/email address in order to receive the Citi Prepaid Card. For more information regarding the Citi Prepaid Card, claimants can visit www.brother-cash.com.au/termsofuse to view the terms of use. Cards will be issued within 5 working days of the proof of purchase being received and validated.

  17. It is the responsibility of the claimant to provide the correct details for the bank account for the cashback payment to be made into if choosing payment by EFT. Payments via EFT will be made within 5 working days of the proof of purchase being received and validated. Returned funds will be subject to a fee from the bank. This fee will be passed onto the claimant and will be deducted from any cashback payment thereafter.

  18. If the claimant of offer is under the age of 18 years, the cashback will be awarded to the claimant’s nominated parent or guardian.

  19. The Promoter accepts no responsibility for any tax implications that may arise from this promotion. Independent financial advice should be sought by the claimant.

  20. Except for any liability that cannot be excluded by law, the Promoter (including its officers, employees and agents) excludes all liability (including negligence), for any personal injury; or any loss or damage (including loss of property); whether direct, indirect, special or consequential, arising in any way out of the Promotion, including, but not limited to, where arising out of the following: (a) any technical difficulties or equipment malfunction (whether or not under the Promoter’s control); (b) any theft, unauthorised access or third party interference; (c) any claim or offer that is late, lost, altered, damaged or misdirected (whether or not after their receipt by the Promoter) due to any reason beyond the reasonable control of the Promoter; (d) any variation in the offer value to that stated in these Terms and Conditions; or (e) participation in the offer.

  21. Claims are not transferable, assignable or exchangeable for other goods or services.

  22. Claims cannot be made on back orders.

  23. This offer cannot be combined with any other promotional offer. This includes special deal pricing or government pricing.

  24. This offer is not valid for rental or leasing agreements.
